Terms and Conditions (T&C)

These Terms and Conditions ("T&C") govern the use of the SkillSwap online marketplace and related services (collectively "Service"). The Service is operated by Bebők Bence, sole proprietor trading as SkillSwap, registered office: 1041 Budapest, Szigeti József utca 10. II/7a, company registration number: 61172506, tax number: 91453118‑1‑41 (the “Provider” or “we”) through the www.skillswap.hu website and its related subpages.

In short: SkillSwap is an intermediary marketplace. Users (buyers and service providers/teachers) contract with each other for the advertised exchange of knowledge and services. We provide the platform, authentication, credit and subscription management, and—where applicable—technical support for invoicing. Premium membership and Skill Credit packages are digital services sold directly by the Provider.

2. Definitions

User: any natural or legal person using the Service (buyer and/or provider/teacher).

Buyer/Client: a user who books a service or purchases credits/premium.

Provider/Teacher: a user who advertises and performs a service on the marketplace.

Skill Credit (“credit”): an internal accounting unit that can be used for bookings on the platform. Credits are not money, cannot be converted to cash, and cannot be transferred.

Premium membership: a monthly subscription offered by the Provider with extra functions and discounts.

Parties: the stakeholders of the legal relationship under these T&C (Provider and User), and the users contracting with each other on the marketplace.

3. Scope of the T&C

These T&C apply to all users of the Service. The Service is provided from Hungary and is available within the European Economic Area. For marketplace transactions, the parties contract with each other; the Provider acts as an intermediary and platform operator. Regarding credits and Premium subscription, the Buyer contracts directly with the Provider.

4. Language, form and archiving of the contract

The language of the contract is Hungarian. Any foreign language versions of the site are for information purposes only; in case of discrepancies, the Hungarian terms prevail. The contract is concluded electronically and is not considered a written contract. Errors in data entry can be corrected during the ordering process. Order data are recorded in the system and are accessible in the user account.

5. Registration and account usage

A user account is required to use the Service. Accurate and up‑to‑date data must be provided at registration. The User is responsible for the security of the account credentials. In case of suspected unauthorised access, an immediate password change is recommended. The Provider may restrict or suspend the account in case of breach, suspected misuse, or violation of community guidelines.

6. Intermediation of marketplace services

The content, quality and fulfilment of services advertised on the marketplace are the responsibility of the respective provider/teacher. The booking process, cancellation conditions and proof of fulfilment are described in the service description and messages exchanged by the parties. The Provider is responsible for providing the platform and transaction infrastructure, for preventing abuse and—for credits and premium—the technical support of invoicing.

7. Skill Credits

Credits can be used for bookings within the platform. Credits are not money, cannot be exchanged for cash and cannot be transferred. Credits may only be purchased by registered users. After successful payment, credits are typically credited immediately (depending on system load, this may take a few minutes). In case of erroneous credit, the Provider will investigate and, if justified, grant a credit or refund. The credit use conditions and the credit price of bookings are contained in the service description.

8. Premium membership (subscription)

The Premium monthly subscription automatically renews but may be cancelled by the user at any time; cancellation takes effect at the end of the current period. The functions and benefits of Premium are described on the platform. The Provider may modify the content of the service within reasonable limits. In case of price changes, the Provider gives prior notice; active subscriptions renew at the new price after the notice period.

9. Prices, packages and payment

Currency: HUF. Unless otherwise stated, the prices shown are gross prices including 27% VAT. The invoice is issued via Számlázz.hu.

Payment method: PayPal (card/PayPal balance). The Provider does not process card data. We reserve the right to change prices. Current prices are valid on the day of publication; in case of promotions and coupons, the differing conditions apply.

The Provider may apply periodic promotions and discounts and reserves the right to change prices and packages.

10. Ordering process and technical steps

Login → select package → initiate payment via PayPal → confirm successful payment → credit is credited / subscription is activated.

Errors in data entry can be corrected in the basket and profile settings before finalising the order. In case of successful payment we send an email confirmation; an invoice is issued automatically.

11. Invoicing

Invoices are issued via the Számlázz.hu system. In case of a company, please provide a tax number. The invoice is sent electronically.

12. Right of withdrawal (consumers)

Digital content/service (credit package, Premium): the Buyer acknowledges and expressly agrees that performance begins immediately upon confirmation of payment, thereby losing the 14‑day right of withdrawal under Government Decree 45/2014 (II.26.) Section 29 (1) m). In cases of defective performance or mandatory rights, legal remedies may of course be exercised.

Marketplace services: the withdrawal/cancellation conditions are determined by the respective provider; these are communicated in the service description and during booking.

13. Liability and warranty

Providers are responsible for the content and fulfilment of services advertised on the marketplace. To the extent permitted by law, the Provider is not liable for breaches of contract, delays, defective performance or lost profits in the parties’ contracts with each other. We ensure the availability and security of the platform with reasonable care. Temporary outages may occur due to maintenance, development, or force majeure. Statutory warranty applies to our digital services.

14. Behaviour rules and prohibited activities

Prohibited activities include: posting unlawful, misleading or licence‑infringing content; unauthorised use of the system; spamming; violating others’ personal or intellectual property rights; and bypassing the Service (“platform circumvention”). We may remove unlawful or harmful content and restrict accounts.

15. Intellectual property

The website and software elements are protected by copyright. The “SkillSwap” name, logo and branding elements are owned by the Provider. Users are responsible for the content they upload and grant a non‑exclusive, worldwide licence for use of the content to the extent necessary to operate the platform.

16. Data protection

The detailed rules of data processing are contained in the Privacy policy (GDPR).

17. Complaint handling and dispute resolution

Customer service: hello@skillswap.hu – response time: 30 days.

Arbitration board: in the event of a consumer dispute you may initiate proceedings before the competent conciliation board at your place of residence/registered office.

Online dispute resolution (ODR): for cross‑border online purchases, the European Commission’s ODR platform may be used.

Legal action: in accordance with applicable laws.

18. Force majeure

We are not liable for unforeseeable and unavoidable events beyond our reasonable control (e.g., natural disaster, war, regulatory action, internet outage, major external service failure).

19. Modification and termination of the contract

The Provider may unilaterally modify these T&C; users are informed of changes on the website and/or by email. The modification takes effect upon publication. The user may terminate the legal relationship at any time by deleting the account; this does not affect obligations arising from already concluded marketplace transactions.

20. Governing law

These T&C are governed by Hungarian law, in particular Act V of 2013 on the Civil Code, Act CVIII of 2001 on electronic commerce and consumer protection laws.

Annex – Packages and fees (extract)

Note: the fees listed are valid on the day of publication. The Provider reserves the right to change prices. Invoicing is done via Számlázz.hu. Unless otherwise indicated, prices are gross amounts (including 27% VAT).
